Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer motivated his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his racing venture, saying he invested $40m of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan stated during testimony. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan testified for an hour and left the court to pandemonium, with onlookers and reporters vying for a view or a picture of the sports legend.

Leading the Legal Charge

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, submitted in a written letter to Nascar. She said the pressure of the contract signing demand was problematic.

She said, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
