Federal Judge Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to answer alien smuggling charges, he was held in federal custody.
In her order, the judge noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal challenge involve disputed claims. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this claim.
